  • 100% Bonus Depreciation:
    • For qualified aircraft acquired and placed in service after January 19, 2025, 100% bonus depreciation has been restored and made permanent.
    • This allows businesses to deduct the entire purchase price in the first year of service, significantly reducing taxable income and improving cash flow.
    • Both new and used aircraft can qualify, provided they meet "original use" or specific used-property requirements.
  • Section 179 Expensing:
    • Smaller operators may utilize Section 179 to immediately deduct up to $2.5 million of the aircraft cost, offering a flexible alternative for those who may not meet all bonus depreciation criteria.
  • Operating Expense Deductions:
    • Owners using aircraft for trade or business can write off ongoing costs including fuel, maintenance, insurance, hangar fees, and crew salaries.
  • Critical Compliance Requirements:
    • 50% Business Use Test: To claim accelerated depreciation (MACRS or bonus), the aircraft must be used more than 50% for qualified business purposes.
    • Placed-in-Service Rule: Deductions are only available for the tax year the aircraft is fully ready and available for its intended business use. 


State Sales and Use Tax Mitigation


State taxes can exceed 10% of the purchase price, making pre-closing location strategy vital.


  • Tax-Friendly Jurisdictions:
    • Closing in states with no sales tax (e.g., Oregon, Montana, New Hampshire, Delaware) can eliminate upfront sales tax liability.
  • Fly-Away Exemptions:
    • Many states allow buyers to avoid sales tax if the aircraft is removed from the state within a specific timeframe (often 10–30 days) and registered elsewhere.
  • Common Carrier/Interstate Commerce Exemptions:
    • If the aircraft is used primarily for for-hire carriage (like Part 135 charter) or in interstate commerce, it may qualify for full or partial exemption from sales and use tax.
  • Use Tax Exposure:
    • Even if sales tax is avoided at closing, a "use tax" may be triggered when the aircraft is brought to its permanent "home" state. Planning often involves meeting specific out-of-state use periods (e.g., 6–12 months) to qualify for exemptions.
